NBWA Files Amicus Brief Supporting Maryland’s Alcohol Laws

ALEXANDRIA, VA The National Beer Wholesalers Association (NBWA) with the Wine and Spirits Wholesalers of America (WSWA) today filed a brief in support of Maryland state law regulating alcohol in the case of TFWS, Incorporated v. Peter Franchot, et al. In the brief, NBWA argues that this case, like Costco v Hoen which was decided last week, is an issue of core state powers that is not subject to the Sherman Antitrust Act.

“While we are encouraged by the recent decision issued in the Costco case, we recognize that special economic interests will keep fighting in courts to eliminate a state’s ability to regulate. We will continue to work with states and respond to these efforts,” said NBWA President Craig Purser. “America’s beer distributors will continue to advocate for and support effective state-based alcohol regulation.”
